Terms and Conditions

Please read all these terms and conditions. 

​As we can accept your order and make a legally enforceable agreement without further reference to you, you must read these terms and conditions to make sure they contain all that you want and nothing that you are not happy with.​

Section 1 - Application

​This website is owned and operated by . These Terms set forth the terms and conditions under which you may use our website and services as offered by us. This website offers visitors customised products made to order, in both digital forms and physical items. These are terms in which we sell all Goods to you. By ordering any of the Goods, you agree to be bound by these Terms and Conditions. You can only purchase the Goods from the website if you are eligible to enter into a contract and are at least 18 years old. 

​Section 2 - Goods

​The description of the Goods is as set out in the website, social media and other form of advertisement. Any description is for illustrative purposes and there may be small discrepancies in the size and colour of the Goods supplied.

In the case of any Goods made to your special requirements, it is your responsibility to ensure that any information of specification you provide is accurate.

All Goods that appear on the website are subject to availability.

We can make changes to the Goods which are neccessary to comply with any applicable law or safety requirement. We will notify you of these changes.

When buying an item, you agree that: (i) you are responsible for reading the full item listing before making a commitment to buy it: (ii) you enter into a legally binding contract to purchase an item when you commit to buy an item and you complete the check-out payment process.

The prices we charge for using our services / for our products are listed on the website. We reserve the right to change our prices for products displayed at any time, and to correct pricing errors that may inadvertently occur. Section 3 - Price and Payment

​The price of the Goods and any additional delivery or other charges is that set out on the Website at the date of the order or such other price as we may agree in writing.

After ordering you will immediately receive a confirmation with an overview of the ordered items and the total amount, the payment must be made in advance.

This payment options are currently available:

• Creditcard: Mastercard, Visa, Maestro, American Express

• Paypal

After getting the receipt of the payment, we will start making your artwork. The delivery time is different and can be seen in the correct product. In this time your artwork will be made and send for you as soon as possible, but at the latest within the stated waiting time per type of artwork. If unexpected artworks, for whatever reason, have a longer delivery time, this will be communicated to you by e-mail.

Section 4 - Personal Information

We retain and use all information strictly under the Privacy Policy.

We may contact you by using e-mail or other electronic communication methods and by pre-paid post and you expressly agree to this.

Your personal data will be stored in My Digi Doggo's customer system in order to process your order. In addition, Digi Doggo uses your data for internal marketing purposes, such as sending mailings. Of course, Digi Doggo uses your personal data in accordance with the relevant legislation.

​Section 5 - Basis of Sale

The description of the Goods in our website does not constitute a contractual offer to sell the Goods. When an  order has been submitted on the Website, we can reject it for any reason, although we will try to tell you the reason without delay.

The order process is set out on the website. Each step allows you to check and amend any errors before submittig the order. It is your responsibility to check that you have used the ordering process correctly.

You will receive an order confirmaion from us via e-mail. You must ensure that order confirmation is complete and accurate and inform us immediately of any errors. We are not responsible for any inaccuracies in the order placed by you. By placing an order you agree to us giving you confirmation of the contract by means of an e-mail with all information in it (ie the order confirmation).

No variation and amendments can be made to order unless written to us no later than 3 hours after order confirmation was sent to you. ​

Section 6 - Delivery

We will deliver the Goods to the delivery location ( if custom physical product) or to your email address ( if it is digital product) within specified time for each product stated on the product page, or failing any agreement, without undue delay and, in any event, not more than 30 days after the day on which the contract is entered into.

In any case, regardless of events beyond our control, if we do not deliver the Goods on time, you can treat the contract to an end if:

​

1) We have refused to deliver the Goods, or if delivery on time is essential taking into account all the relevant circumstances at the time the order was made, or you said to us before the contract was made that delivery on time was essential; or

​

2) After we have failed to deliver on time, you have specified a later period which is appropriate to the circumstances and we have not delivered within that period.

If you treat the contract at an end, we will promptly return all payments made under the contract.

We deliver worldwide. Different delivery locations have various delivery timeframes. Please check the product page and FAQ section for delivery information and timings. 

Section 7 - Promotional e-mails and content

You agree to receive from time to time promotional messages and materials from us, by mail, email or any other contact form you may provide us with (including your phone number for calls or text messages). If you don't want to receive such promotional materials or notices – please just notify us at any time. 

Section 8 - Prohibited uses

You are prohibited from using the site or its content: (a) for any unlawful purpose; (b) to solicit others to perform or participate in any unlawful acts; (c) to violate any international, federal, provincial or state regulations, rules, laws, or local ordinances; (d) to infringe upon or violate our intellectual property rights or the intellectual property rights of others; (e) to harass, abuse, insult, harm, defame, slander, disparage, intimidate, or discriminate based on gender, sexual orientation, religion, ethnicity, race, age, national origin, or disability; (f) to submit false or misleading information; (g) to upload or transmit viruses or any other type of malicious code that will or may be used in any way that will affect the functionality or operation of the Service or of any related website, other websites, or the Internet; (h) to collect or track the personal information of others; (i) to spam, phish, pharm, pretext, spider, crawl, or scrape; (j) for any obscene or immoral purpose; or (k) to interfere with or circumvent the security features of the Service or any related website, other websites, or the Internet. We reserve the right to terminate your use of the Service or any related website for violating any of the prohibited uses.​

Section 9 - Governing law, jurisdiction and complaints.

​The contract is governed by the Law of England and Wales. Disputes can be submitted to the jurisdiction of the courts of England and Wales.

We try to avoid any dispute, so we deal with complaints in the following way:

If a dispute occurs customers should contact us to find a solution. We will aim to respond with an appropriate solution as soon as possible. ​

Section 10 - Right to change and modify terms.

​We reserve the right to modify these terms from time to time at our sole discretion. Therefore, you should review these page periodically. When we change the Terms in a material manner, we will notify you that material changes have been made to the Terms. Your continued use of the Website or our service after any such change constitutes your acceptance of the new Terms. If you do not agree to any of these terms or any future version of the Terms, do not use or access (or continue to access) the website or the service.
